These terms and conditions of Use (hereinafter the “Terms and Conditions”) govern the relationship between the client, visitor, or user of the INNOVATTIA.com site, (hereinafter the “User”) and Innova TL, S.A. DE C.V., a commercial company existing and duly incorporated in accordance with the laws of the United Mexican States, in relation to the services and products available to the User through the Site. https://innovattia.com/(hereinafter the “Site”)

The User may not use the Site if the User lacks or has limited capacity to accept these Terms and Conditions for any reason. If the User violates the terms and conditions set forth in these terms and conditions, the Site may terminate the User's use, exclude the User from future transactions, and/or take any legal action it deems appropriate. It may also cancel the User's shopping account or report fraud attempts by the User.

The data collected by INNOVATTIA from the User during the use of the Site will be processed by INNOVATTIA in accordance with the Privacy Notice, which is incorporated by reference into these Terms and Conditions. The User and/or Client must carefully read this policy to understand their rights and the obligations contained therein.

The Data will be processed in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations. The Site may eventually be unavailable due to technical difficulties or internet failures, or due to any other circumstance beyond INNOVATTIA's control; In such cases, efforts will be made to restore it as quickly as possible without any liability being attributed to the user. INNOVATTIA is not responsible for any damages or losses of any kind incurred by the User due to failures or disconnections in telecommunications networks that result in the suspension, cancellation, or interruption of the Site's service during or prior to its provision.

Illegal or unauthorized use in accordance with these Terms and Conditions of the Site will be investigated, and INNOVATTIA will take appropriate legal action.

INNOVATTIA shall have no legal or operational liability:

Of access by minors to the content included on the Site, being It is the responsibility of their parents or guardians to exercise adequate control over the activity of minors in their care or to install any of the Internet usage control tools in order to prevent access to materials or content unsuitable for minors, as well as the sending of personal data without the prior authorization or consent of their parents or guardians.
7. Errors or delays in the User's access to the Site when entering their data in the purchasing process, the slowness or impossibility of receiving the order confirmation by the recipients, or any anomaly that may arise when these incidents are due to problems in the Internet network, caused by unforeseeable circumstances or force majeure, and any other unforeseeable contingency beyond the good faith of INNOVATTIA.
8. Faults or incidents that may occur in communications, deletion or incomplete transmissions, such that it is not guaranteed that the Site will be constantly operational.

The User hereby agrees to indemnify and hold INNOVATTI harmless.

Without prejudice to the foregoing, the User accepts that, in any case, in which any liability is attributed, whether direct or indirect, contractual or extracontractual, to INNOVATTIA, its subsidiaries, parent company, shareholders, directors, employees, officers, advisors and agents, the total liability of INNOVATTIA, its subsidiaries, parent company, shareholders, directors, employees, officers, advisors and agents will be limited to the amount of $500 (five hundred Pesos 00/100 currency in legal tender in the United Mexican States).

Users have the option to post content to INNOVATTIA's blogs and forums, as comments. The publication of such content is subject to these Terms of Use. The person identified, in each case, as the person who submitted the content will be responsible for it. The content will not, in any way, reflect the opinion of INNOVATTIA.

INNOVATTIA is not responsible for any errors, inaccuracies, or irregularities that may be contained in the published content, nor for any damages or losses that may arise from the inclusion of content in the sections of the Social Network or other platforms that, where applicable, allow this type of service.

The User supplying the content irrevocably grants INNOVATTIA, on any type of medium, the rights to its reproduction, use, distribution, public communication or any other type of activity on the same.

Likewise, the supplying User declares to be the owner of the rights to the content, where applicable, or guarantees that they have the necessary rights and authorizations from the author or owner for its use by INNOVATTIA.

INNOVATTIA is not responsible for any damages or losses that may arise from the use, reproduction, distribution or public communication or any other type of activity carried out on content that is protected by intellectual property rights belonging to third parties, without the User having duly obtained the necessary authorization from their owners to carry out the use that intends to carry out.

INNOVATTIA reserves the right to unilaterally remove, at any time, the content in any section of the Social Network website, when, due to its content, INNOVATTIA deems it appropriate

Users are prohibited from violating or attempting to violate the security of the Site and INNOVATTIA's affiliated websites; the User is prohibited.

(b)attempting to probe, scan, or test the vulnerability of a computer system or network or to breach security or authentication measures without proper authorization;

(c)attempting to interfere with the use of any other User, host service, or network, including, without limitation, by transmitting a virus to the Site or INNOVATTIA's affiliated websites; causing an overflow of such sites through 'flooding,' 'spamming,' 'mailbombing,' or 'crashing';

(d)the sending of unsolicited email, including promotions and/or advertising of products or services, or;

(e)falsifying any TCP/IP packet header or any part of the header information in any email or newsgroup posting.

The User acknowledges that violations of computer system or network security may give rise to civil or criminal liability. INNOVATTIA will investigate situations that may involve such violations and reserves the right to report such actions to the authorities; INNOVATTIA will cooperate with the competent authority in the investigation of such violations under the terms established by applicable law.

INNOVATTIA informs its Clients and Users that has a profile on some Social Networks: Facebook, Twitter, LinkedIn, Pinterest, YouTube, and Instagram (each of them, interchangeably, a 'Social Network').

All of them were created with the primary purpose of advertising the Products. The Client or User may join the Groups or Profiles that INNOVATTIA has on different Social Networks. The User who becomes a follower of any of these Groups or Profiles, thereby showing interest in the information advertised on the Social Network, accepts the terms of use and privacy policy of the corresponding Social Network.

INNOVATTIA may access and process the User's public information, specifically their contact name. This data will only be used within the Social Network itself and will not be incorporated into any database, unless otherwise indicated.

The User may access the privacy policies of the Social Network itself at any time, as well as configure their profile to guarantee their privacy.

Using the INNOVATTIA profile will perform the following actions:

–Access to public profile information.

–At the User's request, publication on the User's profile of information that has previously been published on the INNOVATTIA page.

–Sending individual messages through Social Network channels, when permitted.

–Page status updates that will be displayed on the User's profile. The User may control their connections at any time and delete content that no longer interests them. They may also modify and restrict who they share their connections with through their privacy settings.

Contests, promotions, and sweepstakes on the Site and Social Networks. INNOVATTIA reserves the right to hold contests, promotions, and sweepstakes, in which Users linked to their page may participate.

The rules for each of these, when conducted through the corresponding Social Network platform, will be published therein, in accordance with applicable law.

INNOVATTIA may at any time suspend access to the Site and/or terminate these Terms and Conditions.

INNOVATTIA reserves the right to modify these Terms and Conditions at any time. These Terms and Conditions will be effective once they are published on the Site and/or the modifications are communicated to the User by email. If the User does not accept the modified terms and conditions, they must stop using the Site.
